There aren't any 40 MHz machine-language compatible parts.

To see this for yourself, do this:
Go to the Microchip parametric search page for the PIC16 chips:
http://www.microchip.com/ParamChartSearch/params.aspx?branchID=1002&mid=10&lang=en&pageId=74
Find this line:
Quote:
Max. Speed MHz

Select "40" (for 40 MHz).
The click the "Search" button and after that, click the "Detail" button.
It will give you a list of PIC16 chips that can run at 40 MHz.
Look at the details of the chips. They're not compatible with the 16F877.

Your only good choice is to go to the PIC18F series. That requires the
PCH compiler (not the PCM compiler).

Depends on your project. 18F458 is pin to pin compatible, with small exceptions. And if your code was written in CCS it will work with very few modifications.
